Regulation of crypto-assets of the European Parliament and of the Council on Markets in Crypto-assets, and amending Directive (EU) 2019/1937, provides a comprehensive Union legal framework relating to:
- issuance and admission to trading of crypto-assets;
- authorization and supervision of service providers;
- operation, organization, and governance of issuers;
- consumer protection rules for the issuance, trading, exchange, and custody of crypto-assets;
- measures to prevent market abuse.
Scope of regulation of crypto-assets
The regulation applies to persons engaged in the issuance of crypto-assets. These are legal entities that publicly offer any type of crypto-assets or that wish to admit these crypto-assets to a trading platform. Also, persons who provide services related to the issuance of crypto-assets. Such as:
- custody and supervision on behalf of third parties;
- trading platform supervision;
- exchange against fiat currency;
- exchange of some crypto-assets against others;
- execution of orders on behalf of third parties;
- placement;
- receiving and transmitting orders on behalf of third parties;
- provision of consultations.
